Mane Stylist visitor and reviewer Terms of Services:

Please read Mane Stylist Terms of Service “Terms” carefully. These Terms are between you (“you” or “your”) and Mane Stylist GP (Mane Stylist, “we” or “our”) in these Terms may refer to Mane Stylist registered user, a reviewer, a hair stylist, a barber accessing ManeStylist.com (“Site”) as a consumer, or anyone accessing the Site.

You accept and agree to be bound by these Terms and any other policies in place when you access or use the Site. If you do not agree to abide by or be bound by these Terms, then do not use or access the Site, register for an account (reviewer, hair stylist or barber account), or sign up for a service.

1. General Terms

We reserve the right to make changes to the Site, Terms of Service, Privacy Policy, or any other policies. If we make any material changes to these Terms of Service, or any other services, then we will notify you regarding these changes either by email or by posting a notice on the Site prior to the effective date of the changes. These Terms are effective upon acceptance by new users. For our current users these terms are effective as of January 1, 2021 and supersede all previous versions of our Terms of Services. If any section or portion of these Terms shall be deemed severable and shall not affect the validity of the remaining conditions. Your continued use of the Site after any such changes are posted continues your acceptance of the Terms. If you do not agree to abide by these or any future Terms, you may not access or use the Site.

2. How and When You May Use the Site

You may use the Site only to post reviews based on your own personal experience. You may only use the Site for persona, non-commercial uses, and you may not use the Site to advertise or promote a product, service, procedure, business, or another person.

You may not use the Site:

-if you are under the age of 18.

-in any way of for any purpose that is against any local, state, federal or any other applicable laws.

-to exploit, solicit, or harm minors.

-to copy any content from the Site, including but limited to photographs, and post those photographs or other content on another third-party website.

-to post or submit any content that is racist, sexist, inflammatory, defamatory, hateful, harassing, threatening, abusive, profane, obscene, vulgar or sexually explicit, false, misleading, fraudulent, invasive of other’s privacy or publicity rights, infringing of other’s intellectual property rights, contains confidential information, or otherwise offensive or objectionable.

-to post your name, email address, or telephone number, URL or any other confidential or personally identifiable information about you or any other person on the Site.

-to register for multiple accounts or use the account of another person without their authorization.

-to impersonate or pretend to be any person other than yourself, including to impersonate or pretend to be a hair stylist, or a barber.

-to attempt to solicit business or direct website visitors to a non-Mane Stylist for commercial purposes or spamming any Mane Stylist hair stylists or barbers, community members or other users.

- to Infringe on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party

-to create and upload reviews in exchange for monetary compensation or other incentive.

-for any other purpose for which the Site is not intended.

In addition, Mane Stylist is not obligated to enforce these Terms against other user, hair stylist or barber or other third-party on your behalf. If you believe another user, hair stylist or barber or other third-party has violated these Terms, then please contact Mane Stylist by sending an email to contact@manestylist.com. Mane Stylist reserves the right to investigate the matter and take whatever action Mane Stylist deems appropriate in its sole discretion.

3. Your Account; Email Consent

In order to use some of the features on the Site, you are required to register and provide information about yourself to us and create a user account (“User Account”). It is your responsibility to maintain the confidentiality of your User Account information, including your User Account password. In addition, you are responsible for all activities that occur in connection with your User Account. You must inform us right away, by sending us an email to contact@manestylist.com about anyone using your User Account without your consent, or any security breach that relates to the Site or your User Account.

You agree to provide Mane Stylist with accurate, current and complete information about yourself as you may be prompted in any registration forms on the Site and promptly update any such information to keep it accurate, current and complete. Mane Stylist reserves the right to refuse, to provide services to anyone, including terminating your User Account and/or preventing you from using services, or accessing the Site or your User Account, with or without cause, at any time and in its sole discretion.

By using the Site, you consent to receive emails from Mane Stylist. Please note that as long as you maintain a User Account, you may not “opt out” of receiving service or account-related emails from Mane Stylist and all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy legal requirement that such communications be in writing.

4. Materials You Post or Provide

You may be able to post or submit reviews, photographs, or videos (including video created through a third-party tool) and other materials on or through the Site (collectively “Submission” or “Submissions”). Your Submissions (including the extent applicable personally identifiable information), are made voluntarily and are subject to our Terms of Service and Privacy Policy. You understand that Mane Stylist is not required to treat any of your Submissions as confidential.

In addition, you understand and agree that your Submissions are not confidential and are publicly available for anyone to view on the Site. By submitting your Submission to the Site, you are hereby expressly granting Mane Stylist a non-exclusive, irrevocable, worldwide, perpetual, royalty free license (including sublicense) to use, copy, distribute, publicly display, publicly perform, modify (including create derivative work) or transmit (including digital transmission of a sound recording) your Submission, in connection with the Site and the Mane Stylist business, in any media formats and through any media channels now known, or hereafter developed. You also grant Mane Stylist permission to publish and use your name, likeness and voice in connection with your Submission.

In addition, by uploading a Submission to the Site, you hereby waive any rights of privacy or publicity. You also grant Mane Stylist the right to grant any of the above rights to other persons or entities, including for the purpose of promoting the Site, or the Mane Stylist business, without any compensation or obligation to you. You also grant Mane Stylist the right and authority to send takedown notices (on your behalf) related to your Submission to any individual or entity under the Digital Millennium Copyright Act.

Mane Stylist will not pay you for your Submission. You also understand and agree that Mane Stylist may, and its sole discretion, refuse, or remove part or all of your submission from the Site at any time if Mane Stylist considers the Submission to be illegal, offensive, harassing, infringing, inappropriate or otherwise violates these Terms of Services or other policies. For each Submission, you represent and warrant that you have all rights necessary for you to post or submit the Submission and to grant the licensees and permissions in this section and that you are solely responsible for the content of your Submission. Further, you represent that your Submission does not violate any law.

Mane Stylist reserves the right to review and monitor Submission, but is under no obligation to do so. Mane Stylist is not responsible for screening, monitoring or editing Submissions. We may monitor your Submissions and may disclose information about you, including the contents of such Submission, if we deem it necessary to conform to legal requirements or respond to legal process, to ensure your compliance with our Terms of Service or other policies, or protect the rights, property, or interest of Mane Stylist, its users, or the public.

5. Reviews or Other Content

Mane Stylist does not have any responsibility, including editorial control, of any content posted on the Site, whether it is posted by visitors, registered users, hair stylists or barbers or third-party content providers. These statements or content are not the opinion of Mane Stylist. Mane Stylist does not make any representations or warranties about the accuracy or reliability of the content posted by website visitors, registered users, hair stylists or barbers on the Site. Mane Stylist website visitors, registered users, hair stylists or barbers are solely responsible for the content posted by them.

The hair stylists and barbers featured on the Site are not employees or independent contractors of Mane Stylist and Mane Stylist does not make any warranties about the licensing, qualifications, or the cost of services featured on the Site. Mane Stylist does not verify license status of hair stylists or barbers featured on the Site. Website visitors or registered users should always verify hair stylist’s or barber’s license with their local board of licensing. Hair stylists and barbers are responsible to keep their license in good standing.

Mane Stylist has not reviewed all of the sites linked to its Website and is not responsible for the contents of any such linked site. The presence of any link does not imply endorsement by Mane Stylist of the site. The use of any linked website is at the user’s own risk.

6. Photograph/Video Policy

Hair stylists or barbers must have consent from individuals and comply with all applicable laws before uploading, submitting or posting any photographs or videos of individuals on the Site. If a hair stylist or barber, or other third-party has submitted, uploaded or posted a photograph(s) or video(s) of you on the Site and you want the photograph(s) or video(s) removed, please email us at contact@manestylist.com.

7. Mane Stylist Intellectual Property

Mane Stylist grants you a limited, personal, revocable, non-assignable and non-exclusive license to use the Site. Mane Stylist owns he text, photographs, videos, visual interfaces, graphics, design, compilation, computer, code, software and other elements and components of the Site, including your Submissions. Mane Stylist owns the copyrights, trademarks, service marks, trade names and other intellectual property and proprietary rights throughout the world associated with the Mane Stylist content and the Site which are protected by copyright, trade dress, patent, trademark laws and all other applicable intellectual and proprietary rights and laws. You may not modify, reproduce, republish, frame, download, transmit and distribute, rent, lease, loan, sell, assign, license, sublicense, reverse engineer, disassemble, publicly display or create derivative work based on any of Mane Stylist content in whole or in part, or the Site except as expressly authorized in writing by Mane Stylist. In addition, Mane Stylist does not grant any express or implied rights in and to the Site and the Mane Stylist content, are retained by Mane Stylist.

8. Changes to the Site, User Account Closure

We may change the Site, delete features of the Site, or add features to the Site at any time and for any reason without notice in our sole discretion. We are not obligated to provide maintenance, technical support or updates to you for the Site, but we may provide these in our discretion.

9. International Use

Although this Website may be accessible worldwide, we make no representation that materials on this Website are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this Website from other locations do so on their own initiative and are responsible for compliance with local laws. Any offer for any product, service, and/or information made in connection with this Website is void where prohibited.

10. Governing Law

These Terms of Service and any dispute or claim arising out of, or related to them, shall be governed by and construed in accordance with the internal laws of the us without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action or proceeding arising out of, or related to, these Terms of Service or the Website shall be instituted exclusively in the federal courts of us.

Mane Stylist Hair Stylists and Barbers Terms of Service:

These hair stylist and barber Terms of Service (“HSB Terms”) are between you – a hair stylist or a barber (“you”, “your”, “hair stylist” or “barber”) and Mane Stylist GP – a Maryland General Partnership (“we”, “our”, “Mane Stylist”). These HSB Terms govern your access and use of the website (collectively “Site”). These HSB Terms constitute a binding agreement between you and Mane Stylist and the term of these HSB Terms will take effect at the time you click “I accept the Terms and Conditions” or use the Site.

Please read these HSB Terms carefully. By clicking “I accept the Terms and Conditions”, or by browsing, accessing and/or using the Mane Stylist Site, you acknowledge you have read, understood, and agree to be legally bound by the HSB Terms or any of our guidelines or policies on our website. If you do not agree to abide by or be bound by these HSB Terms or any of our guidelines or policies, then do not register for an account or access or use the Site.

1. General Terms

Mane Stylist reserves the right to make changes to the Site, these HSB Terms and other policies at any time, including but limited to charging fees at any time for the Site. If Mane Stylist makes material changes to these HSB Terms or other policies, then Mane Stylist will either notify you by email or by posting a notice on the site prior to the effective date of the changes. These HSB Terms are effective upon acceptance by new users. For current users, these HSB Terms are effective as of August 16, 2021 and supersede all previous versions of the Mane Stylist HSB Terms or any other Mane Stylist Terms of Services that you accepted when you registered for an account with Mane Stylist. If any section of those HSB Terms shall be deemed invalid, void, or unenforceable, then that section shall be deemed severable and shall not affect the validity of the remaining sections of these HSB Terms. If you do not agree to abide by these or any future HSB Terms, you may not use or access the Site.

2. Your Hair Stylist or Barber Account, Email Consent

In order to use some of the features on the Site, including having you profile visible to the public, uploading, updating and adding content to you profile, you are required to register and provide information about yourself to Main Stylist by subscribing to one of our subscription options. It is you responsibility to maintain the confidentiality to your account information, including your account password and you are responsible for all activities that occur in connection with your hair stylist or barber account.

The hair stylists and barbers that subscribe to our membership must be a licensed hair stylist or a licensed barber in the state they are going to list in their profile. The license must by issued by the local board in your state, and it must be in good standing. It is your responsibility to keep your license in good standing. Mane Stylist assumes no responsibility for hair stylist or barber licensing, fees or penalties. If any change occurs to the status of your license – loss, termination, inactivity, you must terminate your subscription without any right to a refund from Mane Stylist. If your license is not currently active you may not subscribe to our membership.

Mane Stylist has no obligation to verify if a hair stylist or a barber has a valid license. Mane Stylist makes no representation about the status of each hair stylist’s or barber’s license. If Mane Stylist receives a report that your license is not active, or in good standing, or you are not a licensed hair stylist or a licensed barber, we will immediately terminate your account without any refund.

Mane Stylist does not have any obligation to verify the status of each hair stylist or barber, but we may inquire about the status of your license with your local board of licensing.

By creating your hair stylist profile page, or your barber page, and by clicking “I accept the Terms and Conditions” you agree that any information submitted by you and posted to your profile page is true, accurate and correct. In addition, you agree to keep the information on you profile page updated. You are responsible for all activities that occur in connection with your personal hair stylist or barber page. You must tell us right away about anyone using your hair stylist or barber account without your consent, or any security breach that relates to you account or your profile page.

By using the Site, you consent to receive emails from Mane Stylist, which may include commercial emails. Please not that as long as you maintain an account, you may not “opt out” of receiving service or account related emails from Mane Stylist. If you would like to opt out of receiving commercial emails from Mane Stylist, please email us to contact@manestylist.com

Mane Stylist reserves the right to refuse providing services or the Site to anyone, including terminating your hair stylist or barber account and/or preventing you from accessing the Site, your hair stylist or barber account, with or without cause, at any time and it its sole discretion.

3. How and When You May Use the Site

As a hair stylist or a barber, you may use the Site to create your individual profile (including selecting your primary or secondary specialties and extra services, uploading photos to your profile, providing your contact information), or respond to your reviews.

Except to the extent, you are not otherwise directly authorized by Mane Stylist, you may not use the Site to:

-promote a product or service that you, your employer sells, distributes, or performs or is otherwise affiliated with.

-post review(s) to other hair stylist(s) or barber(s) profiles that are false.

-instruct someone else to post review(s) on other hair stylist’s or barber’s profile that are false.

-trade reviews with other hair stylist(s) or barber(s), compensate someone or be compensated for writing a review on other hair stylist’s, or barber’s profile.

-post false or misleading review(s), including review(s) that are fabricated or exaggerated, or any reviews about you on the Site.

-ask someone else to write you multiple reviews from different accounts that are not based on their personal experience.

However, nothing contained herein will be construed as prohibiting you from posting a content in a response to content posted by another website user about your business, provided that:

(a) you have provided true and accurate registration to Mane Stylist about yourself,

(b) your response is limited solely to providing factual information and explanation to refute any statements or allegations in the posted content about your business and your response does not violate any applicable privacy laws, and

(c) your response does not otherwise attempt to promote your business or serve any commercial purposes, as determined in the sole discretion of Mane Stylist.

Additionally, you may not use the Site:

-if you are under the age of 18.

-in any way if it is against any local, state, federal or any other applicable laws.

-in any way or for any purpose that endangers or harms us or our affiliates, or any customer or Mane Stylist.

-to exploit, solicit or harm minors.

-to copy any content from the Site, including photograph(s), and post those photographs or other content on any third-party website, including your own website.

-to register for multiple accounts or to use the account of another person without their permission.

-to impersonate or pretend to be any person other than yourself.

-to sign up as a hair stylist or a barber without currently having an active and legal license to provide hair and related beauty services.

-to attempt to solicit business or direct website visitors to a non-Mane Stylist for commercial purposes or spamming any Mane Stylist hair stylists or barbers, community members or other users.

-to create and upload reviews in exchange for monetary compensation or other incentive.

-for any other purpose for which the Site is not intended.

4. Materials You Post or Provide; Communications Monitoring; Confidentiality

As a hair stylist or a barber, you may be able to respond to your own reviews, upload photographs, videos (including videos created through a third-party tool) and other materials on or through the Site ("HSB Content"). You understand your HSB Content is not confidential and is publicly available for anyone to view and the HSB Content posted by you must be in compliance with all applicable privacy laws. Further, Mane Stylist is not responsible for the security of any information transmitted through the internet or the Site. You also understand that any HSB Content posted by you may not violate these HCP Terms or any other guidelines and policies of Mane Stylist as well as any applicable federal, state or local laws (including, but not limited to the rules and laws of state or local licensing boards) and the information you provide must not be false, inaccurate or misleading.

By submitting HSB Content on the Site you are hereby expressly granting Mane Stylist a nonexclusive, irrevocable, worldwide, perpetual, royalty-free license (including sublicense) to use, copy, distribute, publicly display, publicly perform, modify (including create derivative works) or transmit (including digital transmission of a sound recording, if applicable) your HSB Content, in connection with the Site, the Mane Stylist business, including without limitation promoting and redistributing part or all of the Site or the Mane Stylist business, in any media formats and through any media channels now known or hereafter developed without any compensation or obligation to you. You also grant Mane Stylist permission to use your name, likeness and voice in connection with your HBS Content. In addition, by posting or uploading HBS Content to the Site, you hereby waive any rights of privacy or publicity. You also grant Mane Stylist the permission to grant any of the above rights to other persons or entities, including, but not limited, for the purpose of promoting the Site, or the Mane Stylist business without any compensation or obligation to you. You also grant Mane Stylist the right and authority to send takedown notices (on your behalf) related to your HBS Content to any individual or entity under the Digital Millennium Copyright Act. In addition, for each HBS Content you post or submit, you represent and warrant that you have all rights and permission necessary for you to post or submit the HBS Content and to grant the licenses and permissions in this section. Further, you represent and warrant that the HBS Content does not violate any law.

You also understand and agree that Mane Stylist may, in its sole discretion, refuse, or remove part or all of your HBS Content from the Site at any time. Mane Stylist reserves the right to review and monitor HBS Content but is under no obligation to do so. In addition, Mane Stylist is not responsible for screening, monitoring or editing the HSB Content. Mane Stylist may disclose information about you, including the contents of such HSB Content, if we deem it necessary to: (1) conform to legal requirements or respond to legal process; (2) ensure your compliance with these HBS Terms or other Mane Stylist guidelines or policies; or (3) protect the rights, property, or interests of Mane Stylist, its employees, its website visitors, registered users, its partners or the public.

5. Reviews or Content Posted by Others.

Mane Stylist does not have any responsibility, including editorial control, of any content posted by other Mane Stylist registered users, hairs stylists, barbers or other third-party content providers on the Site. The statements or content posted by Mane Stylist registered users, hair stylists, barbers or other third-party content providers on the Site are those of the registered users, hair stylists, barbers or other third-party content providers and are not the opinion of Mane Stylist. Mane Stylist does not make any representations or warranties about the accuracy or reliability of the content, including the opinions, statements or information posted by the Mane Stylist registered users, hair stylists, barbers or other third-party content providers on the Site. The Mane Stylist registered users, hair stylists, barbers and other third-party content providers are solely responsible for the content posted by them respectively.

Mane Stylist does not endorse or recommend any specific content, services, products, opinions, hair stylists, barbers or any other material or information available on the Site. In addition, the hair stylists or barbers featured on the Site are not employees or independent contractors of Mane Stylist.

6. Changes to the Site, User Account Closure

We may terminate or suspend your use of the Site at any time in our discretion. Our termination or suspension may be without any cause and/or without notice. You may terminate your use of the Site and close you User Account at any time by sending us an email to contact@manestylist.com, or cancelling it in your membership profile section. Upon termination, your right to use the Site ceases immediately. Once your use of the Site is terminated or suspended, any data you have stored on the Site may not be retrieved later. We may keep your profile content offline, including your reviews, payment information, photographs and video, but retention of this information is not guaranteed. In addition, even if you stop using the Site or your account is suspended by Mane Stylist, Mane Stylist may continue to show or to use some or all of your Submissions. If you decided to cancel your subscription after automatic renewal, you have up to three (3) days to contact us by email at contact@manestylist.com and request a refund. Any subscription refund request made three (3) days past your scheduled renewal date will be declined.

Any legal suit, action or proceeding arising out of, or related to, these Terms of Service or the Website shall be instituted exclusively in the federal courts of us.

9. Copyright Policy.

If you believe that your HCP Content or any other content has been used in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Mane Stylist, Inc. at copyrightagent@manestylist.com or Copyright Agent, Mane Stylist GP, 3527 Falls Rd, Baltimore MD 21211. Provide all of the following in writing: (1) identify the copyrighted work you claim has been infringed or if multiple copyrighted works, then a representative list of such works on the Site; (2) identify the material on the Site that you claim is infringing and with enough detail so that we may locate the material; (3) provide a statement that you have a good faith belief that the use of the material on the Site is not authorized by the copyright owner, its agent, or the law; (4) provide a statement declaring that the notification is accurate, and, under penalty of perjury, that you are the owner of the copyright interest involved or that you are authorized to act on behalf of the exclusive owner; (5) provide information reasonably sufficient to permit Mane Stylist to contact you, such as an address, telephone number, and email address; and (6) your physical or electronic signature.

Upon receipt of notice as described above, Mane Stylist will take whatever action, in its sole discretion, it deems appropriate, including removal of the alleged infringing material from the Site.
